Tenant Buyouts

What this means

A tenant buyout is an agreement in which a landlord offers money or other benefits in exchange for a tenant voluntarily moving out. Tenants are often surprised to learn that a landlord’s first offer may not reflect the full value of giving up a tenancy. A tenant may be surrendering rent protections, long-term housing stability with below-market rent, relocation rights, potential legal claims, or other valuable protections by agreeing to leave.

There is no single amount that every tenant should receive. The value of a buyout can depend on factors such as the tenant’s rent, how long they have lived in the unit, local rent-control or eviction protections, the landlord’s reason for seeking possession, the cost of replacement housing, and the strength of the tenant’s legal position.

For that reason, tenants should understand both the financial offer and the rights they may be waiving before signing an agreement.

Common situations

- Your landlord has offered you money to voluntarily move out

- You are being pressured to accept an offer quickly

- The landlord wants the unit vacant for sale, renovation, redevelopment, or another use

- You pay significantly below current market rent

- You have lived in the unit for many years

- You are protected by local rent-control or eviction laws

- The landlord has not provided the proper buy-out disclosure documents

- You are being asked to sign a release of claims along with the move-out agreement

How Teshale Law can help

Teshale Law helps tenants evaluate buyout offers in the context of the tenancy and the rights the tenant may be giving up. We review the landlord’s proposal, applicable tenant protections, the reason the landlord wants the unit, and the practical cost of relocating before discussing negotiation strategy.

Depending on the circumstances, representation may include negotiating the amount of compensation, move-out timing, payment structure, security-deposit treatment, moving expenses, release language, confidentiality provisions, and other terms designed to protect the tenant.

If you decide to work with Teshale Law on a buyout, the goal is to improve your position—not reduce what is already on the table. Attorney fees are structured around the value obtained through the negotiation, at no out of pocket cost to the tenant.
